Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Mixtape website and related online services operated by Annapurna Productions, LLC (“Annapurna,” “we,” “our,” or “us”) (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

The Service allows users to create, save, and share digital mixtapes using track references, visual styling, decorations, and related features. Features may change over time. We may suspend, limit, or discontinue parts of the Service with or without notice where permitted by law.

Accounts

Some features require an account. You are responsible for your credentials and for activity under your account. You must provide accurate information and keep it up to date where required.

User content and license

You retain rights you may have in content you submit, create, or publish through the Service. You grant Annapurna a non-exclusive, worldwide, royalty-free license to host, reproduce, process, display, distribute, and otherwise use your content solely to operate, promote, protect, moderate, and improve the Service.

You represent that you have the rights needed to submit your content and that your content does not violate these Terms, applicable law, or anyone else’s intellectual property, privacy, publicity, or other rights.

Prohibited conduct

You agree not to:

  • Violate any law or infringe others’ intellectual property or privacy rights;
  • Harass, threaten, or harm others, or upload unlawful, hateful, or exploitative content;
  • Attempt to disrupt, scrape, overload, or compromise the Service or other users;
  • Misrepresent your identity or affiliation, or use the Service for spam or fraud;
  • Circumvent security, access controls, moderation tools, or usage limits;
  • Use the Service to create or share content that violates third-party platform terms.

Moderation and enforcement

We may review, remove, restrict, or disable access to content or accounts that we believe violate these Terms, harm users or the public, or are required to be removed by law. We may use reporting tools, automated or manual review, and other processes to enforce these rules. We may also preserve and disclose information where permitted or required by law or where necessary to protect the Service, users, Annapurna, or the public.

Third-party services and embedded content

The Service may rely on, link to, or embed third-party services, including YouTube for video playback. Your use of third-party services may be subject to their separate terms, policies, and technical controls. Annapurna does not control and is not responsible for third-party services.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANNAPURNA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), IF YOU HAVE NOT PAID US.

Indemnity

You will defend, indemnify, and hold harmless Annapurna and its affiliates, officers, directors, employees, contractors, and agents from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.

Governing law

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless applicable law requires otherwise. Courts in Los Angeles County, California shall have exclusive jurisdiction, subject to mandatory consumer protections in your jurisdiction where applicable.

Changes

We may modify these Terms from time to time. If we make material changes, we may provide notice as required by law. Continued use after changes become effective constitutes acceptance of the updated Terms.
